DECISION AND ORDER

This case is before the Court on the Financial Affidavit of Defendant Mark A. Van Nest. While Mr. Van Nest has not yet been charged with a criminal offense, he has received a March 21, 2007, "target letter" from the United States Attorney stating an intention to file charges and thereupon applied for appointed counsel by completing the Financial Affidavit.

The Financial Affidavit shows a monthly income of $9,700, but monthly expenses of only $6,310. This does not demonstrate that Defendant is qualified for appointed counsel under the Criminal Justice Act Plan of this Court.

The request for appointed counsel is denied. April 5, 2007.
