United States v. Hunter

March 29, 2007

UNITED STATES OF AMERICA PLAINTIFF,
v.
CHRISTOPHER JOSEPH HUNTER DEFENDANT.

The opinion of the court was delivered by: Thomas M. Rose United States District Judge

ENTRY AND ORDER ALLOWING DEFENDANT'S PRO SE MOTIONS (DOCS. 71 & 72) TO BE FILED, DENYING DEFENDANT'S REQUESTS TO REVERSE ITS PREVIOUS ENTRY AND ORDER (DOC. #69) AND TO DISMISS COUNT 1

This matter comes before the Court pursuant to Defendant's Motion to Make Record of Objection and Reverse (Doc. #71) and Motion to Make Record of Objection and to Dismiss (Doc. #72) filed by Defendant, pro se, on March 28, 2007.

Defendant's Motion to Make Record of Objection and Reverse (Doc. # 71) appears to request the Court to file his objection and/or disagreement with the Court's previous Entry and Order (Doc. #69) denying the Defendant's previous Motion for New Trial or Acquittal (Doc. #55) filed by Defendant's counsel. It also requests the Court to reverse said decision. Although the Court has had this pleading filed of record, as requested, the Court, for the reasons stated in its previous Entry and Order (Doc. #69) DENIES his request to reverse said Entry and Order.

Defendant's Motion to Make Record of Objection and to Dismiss (Doc. # 72) also appears to request the Court to file the objection with the jury verdict in this case finding that the alleged conspiracy existed and was proven beyond a reasonable doubt. It also requests, based upon said objection, that the Court dismiss Count 1. Although the Court has had this pleading filed of record, as requested, the Court DENIES Defendant's request to dismiss Count 1.

IT IS SO ORDERED.
