United States v. Browning

March 22, 2007

UNITED STATES OF AMERICA, PLAINTIFF,
v.
KENT M. BROWNING, DEFENDANT.

The opinion of the court was delivered by: Magistrate Judge Michael R. Merz

BIND-OVER ORDER

This case came on for Initial Appearance on Thursday, March, 22,2007. Defendant, present with attorney, Tom Anderson, waived his right to preliminary examination in open Court. The Court finds the waiver knowing, intelligent, and voluntary and that the Affidavit filed with the Complaint establishes that there is probable cause to believe the Defendant committed the alleged offense. IT IS THEREFORE ORDERED that the Defendant be bound over to the Grand Jury to answer the charges made in the Complaint.

Based upon the report of the Pretrial Services Officer, IT IS ORDERED that bond be set at Own Recognizance with pretrial reporting and conditions as set forth in a separate Order Setting Conditions of Release.
