ORDER

This case came before the Court on February 2, 2007, to consider defendant's motion for release or, alternatively, for an order directing the United States Marshal to make arrangements for him to attend a private viewing for his father, who recently passed away. For the reasons more fully stated on the record at the hearing, the Court denied the former request but granted the latter.

It is therefore ordered that the United States Marshal arrange for a private viewing for the defendant, using the following procedures. The only persons in attendance at the viewing shall be the defendant, the transporting deputies, the funeral director, and/or medical personnel. The defendant's family, friends, or attorney shall not be present for this viewing. The defendant will remain properly constrained at all times. The viewing will last no more than two hours, and may be terminated at the Marshal's discretion if conditions indicate a security threat to the defendant, the Marshal, or the public. No advance notice need be given to the defendant, his family, his attorney, or anyone else acting on his behalf of the time of the viewing. A minimum of two deputies shall be used for this viewing, which number may be increased at the discretion of the Marshal.
