United States v. Horn

December 27, 2006

UNITED STATES OF AMERICA, PLAINTIFF,
v.
SONNY JAMES VAN HORN, DEFENDANT.

The opinion of the court was delivered by: Magistrate Judge Michael R. Merz

BIND-OVER ORDER

Upon the recommendation of the Pretrial Services Officer, and upon motion of the Government, the Pretrial Detention Motion is withdrawn. Defendant, and his counsel, Lawrence J. Greger executed the waiver of Preliminary Examination. The Court finds the waiver knowing, intelligent, and voluntary. Based on the facts set forth in the Affidavit supporting the Complaint, the Court finds there is probable cause to believe Defendant committed the offense alleged in the Complaint. IT IS THEREFORE ORDERED that the Defendant be bound over to the Grand Jury to answer the charges made in the Complaint.

IT IS FURTHER ORDERED that bond is set in the amount of $50,000 unsecured with pretrial reporting conditions as set forth in a separate Order Setting Conditions of Release.
