BIND-OVER ORDER

This case came on for Preliminary Examination on Monday, November 20, 2006. Defendant, present with attorney, Cheryll Bennett, waived his right to preliminary examination in open Court. The Court finds the waiver knowing, intelligent, and voluntary. Based on the Affidavit attached to the Complaint, the Court finds there is probable cause to believe Defendant committed the offense alleged in the Complaint.

IT IS THEREFORE ORDERED that the Defendant be bound over to the Grand Jury to answer the charges made in the Complaint.

IT IS FURTHER ORDERED that bond, previously set in a separate Order Setting Conditions of Release, be continued.
