United States v. Tobias

November 9, 2006

UNITED STATES OF AMERICA, PLAINTIFF,
v.
CHRISTOPHER S. TOBIAS, DEFENDANT.

The opinion of the court was delivered by: Chief Magistrate Judge Michael R. Merz

AMENDED DECISION AND ORDER GRANTING OCCUPATIONAL DRIVING PRIVILEGES PURSUANT TO OHIO REV. CODE §§ 4510.06 AND 4510.021

This case is before the Court on Defendant's Motion for Occupational Driving Privileges pursuant to Ohio Rev. Code §§4510.06 and 4510.021.

Upon examination of the file and Defendant's Motion, the Court finds that the suspension of Defendant's driving privileges would seriously affect the Defendant's ability to continue his employment and his schooling. The Court therefore, SUSTAINS Defendant's Motion and GRANTS the Defendant occupational and educational driving privileges as follows:

For travel between his residence (6379 Ringneck Drive, Dayton, Ohio) and his place of employment, Ashworth Roofing (1054 Watchhill Lane, Centerville, Ohio), and during the course of his employment, working residential roofing throughout the Dayton area Monday through Friday, 6:00 a.m. to 9:00 p.m. In addition, Mr. Tobias is allowed to travel to and from his residence to Sinclair Community College for classes on Saturday and Sunday from 6:30 a.m. to 6:00 p.m.
