ORDER

On September 1, 2006, after plaintiff in Case No. 2:06-cv-351 consented to this procedure, that case was transferred to the undersigned's docket for purposes of both pretrial management and trial. The parties to Case No. 2:05-cv-859 had previously consented to trial before the Magistrate Judge, and the defendants in that case, who are also the defendants in Case No. 2:06-cv-351, did not object to the transfer, so the Court concludes that all parties consent to the Magistrate Judge's plenary disposition of both cases pursuant to 28 U.S.C. §636(c). The Court also construes the parties' filings to be an agreement that the two cases be consolidated.

Therefore, these cases are consolidated for all further proceedings pursuant to Fed.R.Civ.P. 42(a).
