ORDER GRANTING LEAVE TO APPEAL IN FORMA PAUPERIS FROM FINAL JUDGMENT

Upon review of Plaintiff's Supplemental Memorandum (Doc. No. 71), the Court finds that his appeal from the final judgment in this case is not frivolous. Based on his Financial Affidavit filed October 10, 2006 (Doc. No. 69) regarding the Order to Show Cause (Doc. No. 67), the Court finds Plaintiff is unable to pay the appellate filing fee and he is hereby granted leave to appeal from the final judgment in this case in forma pauperis.

This Order does not affect his obligation to pay the prior appellate filing fee, incurred when he filed the Notice of Appeal (Doc. No. 49) from a non-appealable order.
