AGREED ORDER

In accordance with telephonic conferences between counsel for parties and the Court, counsel for the parties have conferred, and with the Court's input, the parties agree as follows:

1. The hearing scheduled for Friday, October 6, 2006, at 9:00 a.m. is hereby continued by agreement of the parties for at least sixty (60) days.

2. The parties request the court to conduct a brief telephone conference on October 6, 2006, at 9:00 a.m. in order to discuss scheduling the hearing.

3. Prior to the completion of such hearing and a disposition by the Court, Beavercreek will not take any action on the subject property with regard to removal of the sign.
