ORDER

On September 6, 2006, Defendant appeared before this Court and entered a guilty plea to a one count information charging him with interstate travel to engage in an illicit sexual act with a minor, in violation of Title 18 U.S.C. §2423(b). At this hearing, Pretrial submitted a status report to the Court requesting that Defendant's bond be modified to include additional conditions that he not reside with any minor and not have any unsupervised contact with any minors. Defendant, through his counsel, objected to said modifications. The Court instructed pretrial to conduct further investigation, including interviewing the daughter of Defendant's girlfriend who currently resides with him.

The local Children's Services office in Newport, Tennessee conducted an interview of the minor and reported that although the minor stated that Defendant never spoke to her or touched her in an inappropriate way, it is still in the best interest of the child for her not to be in contact with Defendant. A restraining order was in the process of being sought in Cooke County Juvenile Court in Tennessee.

Therefore, after considering the report from the Tennessee Department of Children's Services and Pretrial Services, the Court orders Defendant's bond be modified. As a condition of bond, Defendant shall not reside with any minors, nor shall he have any unsupervised contact with any minors. All other conditions of Defendant's bond shall remain the same. If Defendant violates any conditions of bond, his bond will be revoked and he will remain incarcerated pending sentencing.
