REMOVAL AND COMMITMENT ORDER

This case came on to be heard pursuant to Fed. R. Crim. P. 5(c)(3). Defendant herein was arrested in this District upon a warrant issued upon a Complaint in the Northern District of Indiana in Case No. 2:06MJ177AR. Defendant appeared in open Court on August 30, 2006, and after being advised of his rights requested a preliminary examination, an identity hearing and detention hearing on the Government's Motion for Pretrial Detention.

Thereafter on September 6, 2006, this Court held an identity hearing. Upon the evidence adduced the Court finds that the Defendant is the same person named in the complaint. The Court further found upon the evidence adduced that there was probable cause to believe an offense has been committed by Defendant as alleged in the Complaint. Based upon the evidence presented and for the reasons stated on the record in open court, the Court finds by clear and convincing evidence that no condition or combination of conditions set forth in 18 U.S.C. §3142 (c) will reasonably assure the appearance of the Defendant as required and the safety of the community. Accordingly the Government's Motion for Pretrial Detention is GRANTED.

IT IS ORDERED THAT THE DEFENDANT BE REMOVED TO THE

United States District Court for the Northern District of Indiana, where the charges are pending against him, for any other proceedings, as ordered by that court.
