BINDOVER ORDER

This case came on for Preliminary Examination on Wednesday, August 30, 2006. Defendant was present with counsel, Cheryll Bennett, and waived his right to preliminary examination in open Court. The Court finds the waiver knowing, intelligent and voluntary and that, based on the supporting Affidavit, there is probable cause to believe Defendant committed the offense alleged in the Complaint. IT IS THEREFORE ORDERED that the Defendant be bound over to the Grand Jury to answer the charges made in the Complaint.

IT IS FURTHER ORDERED that bond, previously set in a separate Order Setting Conditions of Release, is continued.
