CONFERENCE MEMORANDUM AND ORDER

In light of the settlement conference held before the Court on August 23, 2006, there are many conflicting legal issues that were raised that need to be resolved prior to trial. The Court therefore vacates the October 10, 2006 trial date to be rescheduled after a decision is rendered on the motions in limine.

The parties are ordered to submit motions in limine as to any and all legal issues that may arise during trial, including but not limited to, evidence regarding the calculation of damages, and admissibility of any potential trial exhibits. All motions in limine shall be submitted by October 10, 2006.

IT IS SO ORDERED.
