ORDER TO THE CLERK

The Court has examined Plaintiff's Amended Complaint (captioned "Reply for Amended Complaint)(Doc. No. 9) pursuant to 28 U.S.C. §1915 and concludes that it is not frivolous as provided in that statute.

Accordingly, the Clerk may issue process for service in this case upon receipt of proper forms for service from the Plaintiff. The prohibition on issuance of process contained in the Court's prior Order (Doc. No. 5) is vacated.
