August 23, 2006

BEVERLY W. LANDSTREET, III, ET AL., PLAINTIFFS,
v.
THE MIDLAND LIFE INS. CO., ET AL., DEFENDANTS.

The opinion of the court was delivered by: Judge Smith

Magistrate Judge King

ORDER

The Court has been informed that the parties are participating in private mediation of this case. It is also the understanding of the Court that the parties do not anticipate filing any dispositive motions, therefore this matter will need to be set for trial.

In light of the ongoing mediation, the Court would like the parties to file a joint written status report by November 30, 2006. The report shall indicate whether this matter has settled. If not, the report shall state whether the parties believe that a settlement is possible in this case, and, if so, whether a formal settlement conference before the Court would be necessary to achieve a settlement. Lastly, the report shall state whether all of the parties would consent to have this matter referred to the U.S. Magistrate Judge to conduct all further proceedings, including the trial. 28 U.S.C. § 636(c)(1); Fed. R. Civ. P. 73(b).

This matter will be set for trial on March 5, 2007, at 9:00 a.m. A pretrial conference will be held with the Court on February 7, 2007, at 1:30 p.m.

IT IS SO ORDERED.
