ENTRY AND ORDERING REMANDING THIS CASE TO THE U.S. BANKRUPTCY COURT FOR THE SOUTHERN DISTRICT OF OHIO

All proceedings in this case have been stayed pending appeal pursuant to agreement of the Parties. (Doc. #27). While on appeal, the Parties' apparently settled this case. They then jointly moved the Sixth Circuit Court of Appeals for a limited remand of this case to the United States District Court for the Southern Division of Ohio for further remand to the U.S. Bankruptcy Court for the Southern District of Ohio, for the approval of their settlement. The Sixth Circuit Court of Appeals has now ordered that the Parties' joint motion for a limited remand be granted and has remanded the case to this Court for further remand to the U.S. Bankruptcy Court for the Southern District of Ohio. (Doc. #29.)

Therefore, this case is remanded to the U.S. Bankruptcy Court for the Southern District of Ohio for further proceedings consistent with the Parties' proposed settlement. A copy of the Bankruptcy Court's ruling on the proposed settlement is to be forwarded to the Sixth Circuit Court of Appeals as a part of the supplemental record on appeal.
