ORDER ENFORCING SUMMONS

This case came on for hearing before the undersigned on May 31, 2006. Respondent, Jose Refugio Banda Aleman appeared and offered no defense to the Summons.

The parties unanimously consented to plenary magistrate judge jurisdiction pursuant to 28 U.S.C. §636(c).

Upon agreement of the parties, the Summons served on Respondent on June 18, 2005, is hereby ordered enforced as follows:

1. On June 5, 2006, at 1:30 p.m. Respondent will appear at the offices of Internal Revenue Service Agent Louderback, produce all the documents in his possession, custody, or control which are responsive to the Summons, and answer Agent Louderback's questions about identification of the documents.

2. On June 19, 2006, at 1:30 p.m., Respondent will again appear at Agent Louderback's office and answer under oath any additional questions Agent Louderback may have which are

United States District Court for the Southern District of Ohio pertinent to establishing Respondent's tax liability for 2001, 2002, and 2004.
